Your registration for use of the Millennium Prevention, Inc. (the "Company") website (www.healthmain.com) (the "Site") and the Company's service (the "Service") provided via the Site constitutes your agreement with and acceptance of the Terms and Conditions and this Privacy Policy.

Security

The security of your personal information is important to us. When you enter sensitive information on our Site, we encrypt that information using transport layer security (TLS).

We follow generally accepted industry standards, using administrative, physical and technical safeguards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially reasonable means to protect your personal information, we cannot guarantee its absolute security.

In addition, we urge you to take precautionary measures in maintaining the integrity of your data. Please be responsible in making sure no one can see or has access to your personal accounts and log-in username and password information. If you use a public computer, such as the library or a university, or a shared device, always remember to log out of the Site or Services.

If you use our Site or Services through your employer’s computer network or through an internet café, library or other potentially non-secure internet connection, use it at your own risk. It is your responsibility to check beforehand with the company’s privacy and security policy with respect to Internet use.

We cannot guarantee the identity of any other person with whom you may interact in the course of using the Site or Services, or the authenticity of any information that others may provide.

Information Collection and Use

The Site collects information from our users at several different points on our Site. When you use the Site, some basic, general information is collected. This general information is used internally in connection with our business to improve the Site, including our marketing and advertising efforts, and to make your use of the Site as enjoyable and efficient as possible.

When you set up an account on the Site, we collect personal information provided by you that may include, without limitation, your: (i) first and last name; (ii) street address; (iii) email address; (iv) phone number; (v) personal health information; (vi) personal diet and exercise information; and (vi) browsing patterns. We use this personal information in order to provide you with the content that you request on our Site. We use your email address to provide you with information about other services available on our Site. Your phone number may be used by us in the event that our customer service representatives need to contact you regarding customer offers or information you have requested or we need to provide to you.

The Company ("we" or "us") operates the Site and we are the sole owner of the information collected on it. We will not sell, share, or rent this information to a third party in any way other than as disclosed in the Terms of Use or this privacy policy without your opt-in agreement.

We will use and share your personal information in certain ways. When we share this information with others outside of the Company, we will share what is reasonably necessary. When we act in response to your written permission, e.g., to share information with your health care provider(s) or others, or are directed by the law, we will share all information that you or the law permits or requires. Every possible example of how we may use or share information is not listed below. When possible, we will use health information that does not identify you.

We may use and share your health information so that we can better operate the Service. We may share your health information with our staff or contracted researchers so they can develop plans to conduct research. We may share information with our staff for review and learning purposes.

We may share your health information with contractors who perform services on our behalf. The contractor must agree in writing to protect the confidentiality of the information.

We may use and share your health information to tell you about nutrition, exercise, and other health-related benefits and services that may interest you.

We may use or share your health information for marketing purposes without your permission to provide you with an inexpensive promotional gift related to the Service. For other types of marketing activities we will obtain your written permission before using or sharing your health information.

We may also offer, from time to time, cash or promotional gifts as incentives for participation in the use of the Site or in activities described on the Site, funded by the sponsor of your participation in the Service or otherwise.

We will not share your name or any identifiable health information with others without your authorization. If you have been referred to the Site by a health care provider we will ask you for authorization to share information with that provider in the course of your registration to use the Site. We may share de-identified information with other persons from time to time.

We may use and share your health information for research 1) if the researcher obtains permission from an institutional review board that decides if the request meets certain standards required by law, or is exempt from such requirement; or 2) if you provide us with your written permission to do so. We may also share your health information with a contractor who will remove information that identifies you so that the remaining information can be used for research.

We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities and may, in our sole discretion, disclose personal information or other information to satisfy any law, regulation, subpoena, or government request. We reserve the right to release personal information or other information about users who we believe are engaged in illegal activities or are otherwise in violation of our Terms of Use, even without a subpoena, warrant or court order, if we believe, in our sole discretion, that such disclosure is necessary or appropriate to operate our web site or to protect the rights or property of the Company, our affiliates, or our officers, directors, employees, agents, third-party content providers, suppliers, sponsors, or licensors and is not inconsistent with our obligations under applicable law. We also reserve the right to report to law enforcement agencies any activities we reasonably believe in our sole discretion to be unlawful. If we are legally compelled to disclose information about you to a third party, we will attempt to notify you by sending an email to the email address in our records unless doing so would violate the law or unless you have not provided your email address to us.

Genetic Information

The Genetic Information Nondiscrimination Act of 2008 (GINA) prohibits employers and other entities covered by GINA Title II from requesting or requiring genetic information of an individual or family member, except as specifically allowed by this law. To comply with this law, we are asking that you not provide any genetic information when responding to this request for medical information, except where there is a specific request for genetic information (including without limitation family history) in connection with an employer-sponsored wellness program, as described in greater detail below, and you elect to provide such information. "Genetic Information" as defined by GINA, includes an individual's family medical history, the results of an individual's or family member's genetic tests, the fact that an individual or an individual's family member sought or received genetic services, and genetic information of a fetus carried by an individual or an individual's family member or an embryo lawfully held by an individual or family member receiving assistive reproductive services.

One of the exceptions to GINA Title II relates to employer-sponsored wellness programs, and your participation in the Service may fall into this category. You may be asked for "genetic information" - which includes family history - on the Site in connection with such programs. Whenever we ask you for such information, we will highlight the fact that it is genetic information. All such information will be maintained by us as private, and will not be shared by us with other persons, unless it is de-identified, without your authorization. (Data privacy and security is described in greater detail elsewhere in this Privacy Policy and in the Terms of Use.) Providing genetic information on the Site is not mandatory, you may not be penalized in any way for electing not to provide genetic information, and its provision is not required for any reason, including, for example, participation in any wellness or other program for which you are otherwise eligible (e.g., you may decline to answer questions about family history on a questionnaire administered in connection with a smoking cessation program which may include monetary incentives for participation and, if you are a smoker, you may still participate in the program and receive any monetary incentives available to program participants).

Disclaimer of Responsibility once Personal Information is Downloaded by You.

The Site does or will give you the option to share personal information stored on the Site with your health care provider or other third parties (e.g., by generating PDF versions of information stored on the Site). Once you download, save or share your personal information, including without limitation, genetic information, anywhere not on the Site, we are not responsible for its dissemination or release to third parties, whether or not intended to be shared by you. We will continue to maintain the privacy of your personal information stored on the Site.

Right to Ask for an "Accounting of Disclosures."

You have the right to ask us for an "accounting of disclosures." This is a list of those people and organizations who have received or have accessed your health information (which is maintained and transmitted by us in electronic format). This right does not relate to information made available when you have provided us with permission to do so. You must put your request in writing. You must include in your written request how far back in time you want us to go, which may not be longer than three years.

Right to Authorize Sharing and to Ask for Limits on Use and Sharing.

You have the right to ask us to limit the use of your health information (e.g., by excluding it from research), and/or to share certain health information electronically (e.g., with a health care provider, family member or friend), and to limit the health information that we share with such persons. In any request for limited use, or limited information release, you must tell us 1) what information you want to limit; 2) whether you want to limit our use, disclosure or both; and 3) the person the limits apply to (for example, your spouse).

Right to Ask for Confidential Communications.

You have the right to ask that we contact you about your health information in a certain way or at a certain location that you believe provides you with greater privacy. For example, you can ask that we contact you at work or by mail. Your request must state how or where you wish to be contacted. You must make your request in writing. You do not need to provide a reason for your request. We will comply with all reasonable requests.

Registration

To use some features on the Site, a user must first complete a registration form on the web site. During registration, a user is required to give contact information, such as name and email address. This information is used to contact users about the services on the Site for which they have indicated interest. Various pages on the Site ask users to provide additional demographic, diet, nutrition, exercise and other lifestyle behavioral information; we encourage our users to provide such information so that they can take full advantage of the Service and have a more personalized experience on the Site.

Cookies

A cookie is a text file stored on the user's computer's hard drive containing information about the user. Websites create cookies to record information about a user's preferences. Cookies are also used to help us determine the various services you use and the support you may need, and to help us detect and solve any problems you may have while using our Site. In addition, the use of a cookie on the Site will enable users to log on to the Site. Most cookies expire after a certain time period.

Web Analytics Services & Tracking

The Company and the Site use Google Analytics, a web analytics service provided by Google, Inc. ("Google"). The information collected about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google commits that it will not associate your IP address with any other data held by Google. Session cookies are required in order to enable your login to the Site; other cookies are used to provide the full functionality of this website. By using the Site, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

We may also use internet tags (also known as action tags, web beacons, single-pixel GIFs, clear GIFs, invisible GIFs and 1-by-1 GIFs) and cookies at this site and may deploy these tags/cookies through a third-party advertising partner or a web analytical service partner which may be located and store the respective information (including your IP address) in a foreign country. These tags/cookies may be placed both on online advertisements that bring users to the Site and on different pages of the Site. We use this technology to measure the visitors' responses to the Site and the effectiveness of our advertising campaigns (including how many times a page is opened and which information is consulted) as well as to evaluate your use of this website. The third-party partner or the web analytical service partner may be able to collect data about visitors to our and other sites because of these internet tags/cookies, may compose reports regarding the Site’s activity for us and may provide further services which are related to the use of the Site and the internet. They may provide such information to other parties if there is a legal requirement that they do so, or if they hire the other parties to process information on their behalf. Log Files

Like most Websites, we use log files on our servers. These log files store information regarding IP (internet protocol) addresses, browser type, ISP (internet service provider), referring/exit pages, platform type, date/time stamp, number of clicks, and log-ons to the Site. These log files are used to analyze trends, administer the Site, track users' activities and use of various features of the Site via anonymized identifiers (e.g., "user 789"), and gather broad demographic information for our use. IP addresses, etc. are not linked to personal information.

Sharing of General or Demographic Information

We may also use non-personal information to analyze data into useful information. This process of data mining is done in the aggregate, is non-personal, and allows Company to find correlations and patterns in the data.

We may share aggregated, general or demographic information we collect about our users and their use of our Site with our partners in a manner which does not identify any individual user. We may partner with other parties to provide specific services that are available on our Site. When a user signs up for these services, we will share the user's name or other contact information that is necessary for the third party to provide these services to the user. These parties are not allowed to use such personal information except for the purpose of providing these services.

Links

The Websites contain links to other Websites. We want you to be aware that when you click on such links which take you to a third-party Website, you will be subject to such third-party's privacy policies. Please be aware that we are not responsible for the privacy practices of such other Websites and we expressly disclaim any and all liability for the actions of third parties, including, without limitation, actions relating to the use and/or disclosure of personal information by such third parties. We encourage our users to be aware of when they leave our Site and enter a third-party Website and to read the privacy statements of each and every Website that collects their personal information. This privacy policy applies solely to information collected by our Site.

Communications from our Web Sites

We send each new member a welcoming email to verify his or her password and user name. Established members will occasionally receive information on services. Each user has the option to not receive these types of communications (see Choice/Opt-Out below).

Occasionally, it is necessary to send out service-related announcements. For instance, if our service is temporarily suspended for maintenance, we might send you an email informing you of such service interruption. Generally, users may not opt-out of receiving these service-related communications. In addition, we communicate with our users on a regular basis to provide requested services and regarding issues relating to their account via email.

Correction/Updating Personal Information

If a user's personal information changes or if a user no longer desires our service, we will enable our users to correct, update or remove from our Site the personal data they provided to us. Such changes can be made either through the member information page on our Site or by emailing our Webmaster at webmaster@healthmain.com.

Choice/Opt-out

Our users are given the opportunity when registering with our Site to opt-out of having their information used for purposes not directly related to the provision of services through the Site. Our registration form has an opt-out mechanism so users may elect to not have their email address added to our marketing and promotional address lists.

Users who do not wish to receive marketing and promotional materials from our partners or us may opt-out of receiving these communications by replying to any such promotional email indicating your desire to not receive such emails or by emailing our Webmaster at webmaster@healthmain.com. Users of the Site will be notified if, in connection with the use of a particular service on our Site, their information will be collected by any outside third-party. At such time, the user can determine whether they wish to proceed with a service that will involve an outside party having access to their information.

Collecting Information From Children Younger than 18

The Site does not knowingly collect or use any personal information from children under the age of 18 without obtaining verifiable parental consent.

Notification of Changes in Use of Information

Our privacy policy is subject to change. In the event of any change, we will provide notice of such change on the Site, and we will also revise the "last updated" date at the top of the privacy policy. For material changes to this privacy policy, we will notify you either by placing a prominent notice on the Site or by email. We encourage you to review this privacy policy periodically to stay informed about how we are helping to protect the personal information we collect. Your continued use of the service constitutes your agreement to this privacy policy and any updates. If we want to use your personal information in a manner different from that stated to you at the time you provided such information to us, we will notify you of such change by posting notification of such change on the Site. At such time, you can determine whether you wish to allow us to use your information in this different manner. If you have opted out of all communication with the Site or have deleted or deactivated your account with us, then you will not be contacted and your personal information will not be used.
